Una trentena eurodiputats (34, concretament) han firmat una pregunta escrita a la Comissió Europea (CE) en què se li demana si creu que la Llei 4/2015, anomenada Llei de Protecció de Seguretat Ciutadana i coneguda com a Llei Mordassa, i el Codi Penal espanyol, no estan en contradicció amb els articles 11 (“tota persona té dret a la llibertat d’expressió”) i 12 (“dret a la llibertat de reunió pacífica i a la llibertat d’associació en tots els nivells”) de la Carta de Drets Fonamentals de la Unió Europea. En aquest sentit, es recorda que el Tribunal Europeu dels Drets Humans va dictaminar contra l’article 490 del Codi Penal espanyol, que protegeix determinades institucions contra l’ofensa pública, perquè considera que aquestes disposicions no estan alineades amb l’article 10 de la Convenció Europea de Drets Humans. Aquests articles romanen sense modificacions i han estat la base jurídica d’aquestes sentències recents.

En la pregunta es fa referència a la condemna a tres anys i mig de presó al cantant de rap mallorquí Josep Arenas Valtonyc per una cançó en què, suposadament, s’ofèn els Borbons; al segrest per part d’un tribunal espanyol del llibre sobre el narcotràfic a Galícia, Fariña, de Nacho Carretero; a la retirada de l’obra Presos polítics espanyols contemporanis de Santiago Sierra a la fira Arco de Madrid, i al judici que s’ha fet al també cantant de rap Pablo Rivadulla, Pablo Hasel, acusat de calúmnies contra la Corona i l’Estat, i que podria ser enviat a presó per la pena que se li demana.

Els diputats expressen la seva preocupació per aquests fets, que consideren vulneracions de la llibertat d’expressió. Tots han passat les últimes setmanes, i els tres primers en les últimes 48 hores.

Freedom of expression under threat in Spain

This week Mallorcan rapper Valtonyc was sentenced to three and a half years in jail by the Spanish Supreme Court accused of exaltation of terrorism and slander against the Crown due to the lyrics of a song. Earlier this week, a court ordered copies to be seized and the stop to print or sold the book ‘Fariña’, which reveals the relationship between drug traffickers and some politicians; also an art piece regarding political prisoners in Spain was censored in the art exhibition ARCO. Singer Pablo Hasel, accused of slander against the Crown and the State is also awaiting the resolution of his trial and could be sent to prison.

The European Court of Human Rights has ruled against article 490 of the Spanish Criminal Code which provide protection to certain institutions against public offense. The Court sentenced those provisions were not aligned with article 10 of the European Convention of Human Rights. Those articles remain unchanged and have been the legal base for those recent rulings.

Does the Commission consider that the Spanish Law 4/2015 and the Spanish Criminal Code is fully aligned with articles 11 and 12 as enshrined in the Fundamental Rights Charter of the European Union?
